The short answer

Condo associations in Cape Coral need a structural integrity reserve study at least every 10 years for buildings three habitable stories or higher, and no SIRS may be completed after 31 December 2026. Cape Coral says no building in the city is within three miles of the coastline, so the 30-year rule applies everywhere. Buildings with a certificate of occupancy from 1 July 1992 or earlier were due by 31 December 2024.

The numbers that drive a SIRS

Eight required items, plus any other item whose deferred maintenance or replacement cost is above $25,000, or the Division's inflation-adjusted figure of $25,675 for 2026.

Items with a remaining useful life over 25 years do not need replacement reserves, though the study may still set a deferred maintenance amount.

  • Buildings with a certificate of occupancy issued on or before 1 July 1992 had to complete the initial inspection before 31 December 2024.
  • The building official sends notice by certified mail, generally about 180 days before the due date, if results have not already been submitted.
  • Once the notice arrives, the association has 180 days to complete Phase 1.
  • Repairs for substantial structural deterioration must begin within 365 days of receiving the Phase 2 report; if they do not, the building official decides whether the building is unsafe for occupancy.
  • The association arranges and pays for the inspections and may hand tasks to a management company, but it remains responsible for compliance.
  • Phase 2 is required when Phase 1 finds structural deterioration, and the inspector decides whether to use destructive or non-destructive testing.
  • The Building Division is at 1015 Cultural Park Boulevard and takes questions at (239) 574-0401, Monday to Friday.
  • The city's condominium inspection FAQ describes the structural milestone inspection only and does not mention electrical reports, thermography or parking lot items.

How we handle structural integrity reserve studies in Cape Coral

Under Cape Coral's 30-year rule, a canal-front condo can reach its first milestone inspection after its first SIRS was due. Where a milestone falls within the five years before the study, it can replace the SIRS visual inspection; otherwise we arrange the visual inspection for the reserve professional and plan the next study around the city's notice.[1][2]

What does a SIRS cover?

At a minimum the roof; the structure, including load-bearing walls and primary structural members and systems; fireproofing and fire protection systems; plumbing; electrical systems; waterproofing and exterior painting; windows and exterior doors; and any other item above the reserve threshold whose failure would harm those items. For each item the study gives the estimated remaining useful life and the replacement cost or deferred maintenance expense, and it includes at least a baseline funding plan that keeps the reserve cash balance above zero in every budget year.[2]

Who may perform or verify the study?

An engineer licensed under chapter 471, an architect licensed under chapter 481, or a person certified as a reserve specialist or professional reserve analyst by the Community Associations Institute or the Association of Professional Reserve Analysts. The rule covers the visual inspection portion too. We arrange the study with one of these professionals and coordinate the schedule; the professional signs the study.[2][3]

What are the deadlines?

  • Owner-controlled associations existing on or before 1 July 2022 had to complete a SIRS by 31 December 2025.
  • With a milestone inspection due on or before 31 December 2026, the SIRS may be done at the same time, but no SIRS may be completed after 31 December 2026.
  • After that, at least every 10 years.
  • Within 45 days of receiving the study, owners get a copy or notice and the association files a statement with the Division.

How does the SIRS change the budget?

Reserves for the SIRS items must be based on the most recent study, and for budgets adopted on or after 31 December 2024 an owner-controlled association that must have a SIRS cannot vote to waive or reduce those reserves, except a multicondominium with a Division-approved alternative funding method. SIRS items may be funded by regular assessments, special assessments, lines of credit or loans; the last three need a majority of the total voting interests.[2]

Frequently asked questions

How does the Cape Coral inspection schedule affect our SIRS?

The City of Cape Coral states that no building in the city is located within three miles of the coastline, so every condo and co-op building follows the 30-year milestone requirement, despite the canals and the Caloosahatchee. A milestone inspection completed within the previous five years may replace the visual inspection portion of the SIRS.

Is Cape Coral on a 25 or 30-year schedule?

30 years. The city states that no building in Cape Coral is within three miles of the coastline, so only the 30-year requirement applies.

How much warning does Cape Coral give?

The city says it sends notice by certified mail about 180 days before the due date, if results have not already been submitted.
