The short answer

The SIRS sets the reserve schedule, and Boca Raton boards can fund it with regular or special assessments, lines of credit or loans, with a majority of the total voting interests for a special assessment, line of credit or loan. Palm Beach County was among the three counties with the most required Phase 2 inspections in 2024. Boca's guidelines add a specific inspection of underground and lower-level garages.

  • Palm Beach County, home to Boca Raton, was one of the three counties with the most required Phase 2 inspections in 2024.
  • The guidelines single out underground and lower-level garages, citing low ground elevation, a shallow and rising water table, porous ground and a corrosive coastal environment, and add an inspection of how the garage has been maintained.
  • Once the city finds the report sufficient, the owner has 365 days to start the repairs under permit, unless the Building Official or engineer of record sets a shorter time, and the repair permit must stay active. After the work, the engineer re-inspects and files a sealed letter or amended report.
  • Late reports, uncorrected reports and repairs that do not start on time can lead to an order of enforcement, with fines through the Special Magistrate.
  • Covered buildings recertify at 30 years, or at 25 years for condo and co-op properties within three miles of a coastline as defined in s. 376.031; threshold buildings recertify at 30 years.

How we handle reserve funding plans in Boca Raton

Boca Raton's checklists ask for separate structural and electrical safety reports, and both systems are SIRS items. When the recertification falls inside the five years before the SIRS, we give the reserve professional both reports and the photos filed with the city, which keeps the study tied to the building's real condition.[3][4]

What funding options does the law allow?

Condominium meeting room table with closed binders, a calculator, pens and rolled building drawings
  • Regular assessments set in the annual budget
  • Special assessments, with a majority of the total voting interests
  • A line of credit or loan, with a majority of the total voting interests, sized to cover any previously waived or unfunded reserves and immediately available to the board
  • Pooling, but only of SIRS components with other SIRS components

Can we pause reserves to pay for milestone repairs?

For a budget adopted on or before 31 December 2028, if a milestone inspection was completed in the previous 2 calendar years, owners may approve by a majority of the total voting interests a pause or reduction of reserve contributions for up to two consecutive budgets to fund the milestone repairs. A new SIRS is required before contributions resume. The option does not apply to developer-controlled associations or associations controlled by owners for less than a year.[4]

What if the building is uninhabitable after a disaster?

If the local building official decides the whole building is uninhabitable because of a natural emergency, the board may pause or reduce reserve funding until the building is habitable again, and may spend reserves to make it habitable.[4]
