The short answer

State law requires repairs for substantial structural deterioration to start within 365 days of the Phase 2 report, and Boca Raton adds its own permit and filing steps. Boca gives 365 days from its sufficiency determination to start repairs under an active permit. Palm Beach County was among the three counties with the most required Phase 2 inspections in 2024.

  • OPPAGA reported that some Palm Beach County jurisdictions accept a single combined Phase 1 and Phase 2 inspection.
  • Boca Raton's guidelines say its recertification combines Phase 1 and Phase 2 of the state milestone inspection into one inspection that meets and exceeds s. 553.899 and Chapter 18 of the Florida Building Code, Existing Building.
  • The guidelines single out underground and lower-level garages, citing low ground elevation, a shallow and rising water table, porous ground and a corrosive coastal environment, and add an inspection of how the garage has been maintained.

How we handle repairs after Phase 2 in Boca Raton

In Boca Raton the city program and the state milestone law cover similar buildings with slightly different tests. Boca counts underground parking toward its three-story or 50-foot threshold, so a building the state would not count can still be on the city's schedule. We check the published 2027 to 2031 schedule and scope one inspection for both where the city allows it.[3][4]

Bids and disclosures

A design professional or chapter 489 contractor bidding on repairs recommended by the milestone inspection may not have an interest in the inspection firm, or be a relative of someone who does, unless that is disclosed to the association in writing. A contract signed without the disclosure is voidable. We collect these disclosures and pass them to the board with each bid.[4]

Paying for repairs

Owner-controlled associations that must have a SIRS may use a line of credit or loan for milestone repairs with a majority of the total voting interests, and for budgets adopted on or before 31 December 2028 may pause reserve contributions for up to two budgets to fund milestone repairs.[10]

Frequently asked questions

How long do we have to start repairs in Boca Raton?

Once the city finds the report sufficient, the owner has 365 days to start the repairs under permit, unless the Building Official or engineer of record sets a shorter time, and the repair permit must stay active. After the work, the engineer re-inspects and files a sealed letter or amended report. Repairs need building permits, so the contractor and drawings should be lined up before the deadline is close.

What does Boca Raton charge for recertification?

$500 per recertification, under Resolution 39-2022.

Does a two-story building over a parking garage count in Boca Raton?

Boca's program counts uninhabitable stories such as underground parking when deciding whether a building is three stories or 50 feet, so it may be covered even if the state law would not count those levels.
