The short answer

Whether a Cape Coral building's first milestone inspection comes at 25 or 30 years is a local decision under s. 553.899(3)(b), based on circumstances such as proximity to salt water. Cape Coral says no building in the city is within three miles of the coastline, so the 30-year rule applies everywhere. Buildings with a certificate of occupancy from 1 July 1992 or earlier were due by 31 December 2024.

How we handle the 25-year coastal rule in Cape Coral

Cape Coral simplifies one question other cities leave open. Because the city says no building is within three miles of the coastline, the first inspection is at 30 years everywhere. The notice usually arrives about 180 days before the due date, so we book the engineer as soon as it comes and keep the association, not just the manager, informed, since the city holds the association responsible.[1]

What changed in 2023?

SB 4-D (2022) made 25 years automatic for buildings within 3 miles of a coastline. SB 154 (2023) replaced that with the local enforcement agency's decision based on local circumstances such as proximity to salt water. Many guides, and some search answers, still quote the old automatic rule.[4][3][2]

Frequently asked questions

Is Cape Coral on a 25-year or a 30-year schedule?

The City of Cape Coral states that no building in the city is located within three miles of the coastline, so every condo and co-op building follows the 30-year milestone requirement, despite the canals and the Caloosahatchee. Your notice letter is the deciding document if anything on a website differs.

Can our management company handle the Cape Coral inspection?

It can take on tasks, but the city says the association remains responsible for compliance.

How much warning does Cape Coral give?

The city says it sends notice by certified mail about 180 days before the due date, if results have not already been submitted.
